I read some gossip on a Hollywood blog a couple years ago, claiming that Tina and Alec started hating each other around season 4 and wanted everyone in the cast to chose sides. If Kate were a man, then the parent's of the younger child possibly wouldn't have pressured the prosecutor to bring charges, and the prosecutor might have never known about the case at all. These parents seem to only be upset that Kate is a woman, not that she's older in general.
