In this case, I would agree that the tavern that overserved the individual would have a vested interest in preventing him from driving. In IL the bartender could very well be fined, and lose his/her bartending license as well. The establishment would likely be fined, and with enough violations could have its liquor

I don't recall the laws on Citizen's Arrest in Illinois, but it could possibly apply here. DUI is *not* a felony, and material evidence wouldn't exist until after the fact, sooo....

Well technically speaking he's probably in a hole in the ground out of sight so, again technically you could be hiding next to him in said hole. That settles it, his assessment is sound.
