Agreed. There was a distinct tonal and temporal shift in the split between the first and second half of the final season. The break in the season helped to sell that difference in a big way. I'm not sure if they wrote for that split, or the split worked in its favor, but it helped it.

I don't disagree with you on the terrible writing part, but I think it's obvious that "murder is on the brain" though when you depict a Batman walking around with a gun, or stabbing a guy in the chest, etc. For instance, the warehouse scene when he's going to save Martha… he does some classic Batman style things there

"Commisioner Gordon, let Robin take a look at the Riddler's riddles. My boy's WICKED SMAHT!"

Fair enough, the "silliness" of it though comes from the juxtaposition of a superhero doing terrible, violent things in the film, though, and murdering more people than the villains actually do.

That could be true. Though the argument is made that he probably is, uh, beating them to death, pretty much, and just not realizing it. One of the funnier imaginings I've had in response to that argument is Daredevil standing with corpses of beaten thugs strewn all over the ground, and him patting himself on the back

I think the point though is that the branding is also something that's relatively silly of an idea. Then again, I'm not a Frank Miller fan, and never was, and his take on Batman others appreciate more than I do.
