Think of the precedent they'd set by saying "Eh, fighting to protect our work is too much hassle. Let 'em do what they want with our song."

There's a difference between using a 2-second sample in a song and using a huge chunk of a song in an advertisement.

Let's talk about GoldieBlox, shall we? This toy is supposed to break down the gender barriers between girls and construction/engineering toys, but it feeds into all the stereotypes: it's pink and lavender, features cute little animals, and has a story to go along with it because I guess girls require emotional content

I don't think "fair use" extends to using someone else's work for commercial purposes. The Fair Use clause is for artists doing creative work, not for companies trying to make profits.
