Yes, very likely. As a union attorney, I can tell you they are most assuredly fired, and likely facing criminal charges. The whole “well she’s not emotionally distressed” is purely to reduce the city’s liability. In other words, trying to make it statutory so to speak rather than “forceable.”

Yes. There is an issue with having sex with people in custody. However, the laws against it are generally aimed at correctional officers so it probably isn’t prosecutable if she was of age. If they were on duty, it’s a internal investigation with consequences dependent upon the details of their union contract.
