Why would there be such gargantuan cost difference between bits that are packaged differently? SMS consumes a very small portion of the network operators…

You are correct in that courts aren't always right (that's truly awful about your friend), but many (most?) times they are. In most countries people are innocent until proven otherwise.
Of course not all date rape is "grey area", but there are certainly cases/incidents where a court has found sex to be consensual.
