My apologies, when I last was an arbitration judge it was just California. Aren’t exceptions wonderful? There are so many to everything it’s amazing what you can get away with, or screwed by.

That was because of the beyond exorbitant cost of defending a class action. The only people that ever get any money out of class action are the lawyers. And they get millions.

California is the only state that has by statue strictly limited enforcement. But, they still do not completely ban non-compete clauses, and have several, very specific exceptions to the general rule. It’s law, there is always some exception to everything.

Noncompete clauses are very enforceable. All federal and state juriscictions in the United States recognize them, with the exception of California, which only recognizes them in very limited circumstances. They can sue for breach of contract.

They are completely enforceable parts of a contract, just as “do not compete” clauses prevent ex-employees from working, sometimes for many years, in the same field or for competing companies.
