That is a completely false statement. You may wish that consent wasn't ambiguous, but the most widely used definition of consent these days is passive and implicit. Hence the new adoption of programs like this.

Well, duh. But in respect to the way they approach the fame on-air, they're doing it pretty responsibly.

I've never look at Disney and Nick's fame-oriented programming to be a negative thing. I've always looked at it as motivating kids to try and achieve something, and it's nicely balanced by their "Make Your Mark" series and partnership with DoSomething.

The reason this law is in place is because consent is very ambiguous. They're trying to avoid cases in which someone consents to something (like an S&M act), and then changes their mind after the fact and decides to press charges.

It's hard to argue with someone when your whole point is that this entire "problem" is virtually a non-issue.
