A 328xi wagon starts at 42, without xenon or 8 way adjustable seats. Throw those in and this car and it aren't very far apart. I'd rather have a wagon, but unfortunately most people in the states would rather have an SUV.

Not with how dealerships are marking them up you can’t. A quick look on Craigslist, it’s hard to find one under $60k. Plenty of dealers are asking 70k+. Of the 350 cars on Craigslist across the country, 4 are listed as less than 55k. (All more than 54).
