Yes, obviously. It harms your credibility if your sources are hidden like that. Unless a source is readily available, not paywalled, then it is worthless as a source for verification or further reading purposes.

The ethical rules governing lawyers simply do not envision this situation. In defense of the profession, I believe this number of retrials is unprecedented, so I’m not sure how big an oversight this is.
