I think was around 9 listed above, mostly third party but still missed the specified target dates and therefore still count. I consider 9 to be a large amount that did not hit the promised release date targets.
What you said does not stop what I said from being true.
It's not like they had high requirements to meet, very limited amount of games for example set to be released during that period and still a huge amount failed to come out in time. But I suppose it still counts as keeping a promise if set the expectations low and reach that low target.

You would still have legal responsibilities and a requirement to follow certain procedures, you could not just fire him on they accusation alone, the employee has for example also the right to defend themselves prior to the dismissal, the right to ask for written explanation and many other rights.
