What are the odds the driver will try to sue the train operator for some unbelievable reason? I didn't see it coming. I didn't hear it coming. I didn't know it was a train crossing. I don't know what flashing lights are. How was I supposed to know you're not supposed to drive around the crossing guards?
No need to be fair to the driver. Ever. They're call railroad right-of-ways for a reason. The train has the right of way. Period. Train will always win even if it's crawling at 3MPH. It will always win.
