agreed, I mean the ATV has brakes and it doesn’t look like he even lifted or otherwise slowed down other than when he was airborne into the hood/windshield.

uh, yeah, right.  If the cruiser had accelerated at the ATV and swerved to hit him maybe I’d side with you but clearly not the same.
