I get what you are saying. I don’t think it’s clear that he didn’t do it, in the same way that I don’t think it’s clear he did do it. If I were on that jury I would not have been able to say confidently beyond a reasonable doubt that he did do it, and I would not have been able to vote to convict.

Yes, “can” frequently is used - incorrectly - to request permission. To say you “can” do something is to say you have the “ability” to do it. Ability can be mental, physical, logistical, practical, financial, and so forth. Your perception that there is a prevailing belief that “can” only refers to physical capability
