I misstated that. If Cohen acted as Trump’s agent, the NDA isn’t signed by Trump and therefore would be unenforceable. If Cohen acted on his own, not as Trump’s agent, then there’s a potential campaign finance violation. It’s going to be messy.

As for who paid, if Cohen paid out of his own pocket with no expectation of being repaid, which is I suppose what he has claimed, then Trump isn’t a party to the agreement. If, on the other hand, Cohen paid as an agent for Trump, then they’ve potentially opened themselves…
