Ok, isn't the problem that he distributed the songs to others rather than he downloaded them? So all the stolen CD analogies are wrong. A better analogy would be stealing a CD, pressing millions of copies of it, and leaving it in a pile around the corner from the record store.

The accept/decline reply thing seems a bad idea. I shouldn't be able to censor the replies to my stupid comments. People should be able to tell me I'm stupid without me being able to delete those comments! I'm too vain to be given that much power!

you're completely missing the point here. regardless of what channel the data is transmitted over, it's still data, and with an easy conversion of video to text, that video file can be sent over a data channel that only transmits data. With a suitable eternity, I could conceivably send an HD video via Morse code.

Open that file and SHAZAM! you have the ASCII encoding of the video file, which you can send as a text message if you split it up in to the smaller bits.
