Looking at it again and you are absolutely correct. He's talking to Spider-man in that picture and it's a big part of Spidey's moral dilemna during the story, but ultimately, it doesn't really require him to be present in order for that to translate well to the film and however it interprets that story arc.

The only thing that bums me out about all this is how the Civil War will be handled without Spider-Man. I'm sure it'll still be awesome, but Spider-Man's involvement really led the forefront of the event for me. From his public unmasking to this moment he had with Captain America:

my understanding is that the characters are not on disc. They were found in the beta files as part of the beta opt-in on steam. Just what I've heard though. Could be wrong.
