I know what preponderance of evidence is, I just didn't understand why it wouldn't be used since my understanding was that it was the standard for most civil trials. Can the judge just alter it like that at his discretion? I thought that was the law, I didn't think the trial judge had the authority to change it.

Why beyond a reasonable doubt? Shouldn't it be a preponderance of the evidence? And did they waive a jury trial? The judge will determine what the law is, but it seems like a jury would have to determine if laying off the workers and negligently securing the customer data caused the loss.

It is tough to compare them, because I'm not sure something similar has happened to the xbox. I know that Kotaku compared the RRoD, but it really isn't the same. Sales are different, gloating about sales is part of the job.

What exactly is the qualification for "original" game? Bioshock Infinite is a franchise, so it doesn't seem to mean new IPs...although Infinite isn't exactly a direct sequel, set in a different area with different characters, so maybe it is still that?

And I agree that not every game needs to be Ocarina of Time quality. But there is a minimum quality bar before I will spend money on it. There is a lot of games I haven't played yet, and if a game isn't good, there is plenty of other games I would rather be playing.

I think that is the problem with reviews really—reviews shouldn't be about trying to predict what everyone else will like. You can't review something like a video game or a movie objectively. You can only give your opinion. But you explain your opinion, so readers can understand your reasoning to see if it lines up

You must not read Ars Technica very much if you think they hate it because it is different. Ars gives a decent proportion of their coverage to indie games and different stuff, that is a big reason why I enjoy Ars's gaming coverage.
