To be honest though, it really is more of an update than a successor. is the jump from DSi to 3DS any more drastic than the jump from DS to DSi?

Its snooping if you are doing it behind their back. If you would pick up their phone and read their text messages while they are sitting right next to you then its ok. If you would get in trouble if they "caught" you, then its snooping and you shouldn't do it. that simple.
