It was deliberate. Ford was more interested in building a legend than building sales. They intentionally cut off production while demand was high to artificially inflate their desirability for years to come. It ensured that the "halo" effect of this halo car would stick around for decades.
Agreed. I doubt this case would make it past a motion for summary judgment. However, discovery alone could cost Porsche a lot of money. Settlement to just make this go away wouldn't surprise me if judges aren't careful about pre-trial motions.

Cool, everybody wins. Look, we all know Ford can't warranty cover a race car. No company can. The wear and tear of actual racing makes everything into a consumable part if all you're doing is competitive racing. They found a way to add this feature and allow customers to use it without voiding the warranty.
