I'm talking as far as console and non-social PC games go. I don't want to sound like a prick by saying "real" games, but basically anything that you would expect to find burned on a DvD or Blu Ray disk and sold at, roughly, 60 USD retail.
Western games get far better marketing, even in Japan. In the west most of the few games that have been lucky enough to come here have shit, if any, marketing and are always met with the harshest of criticism (weather it deserves it or not).

I think you could get away with it with a lesser known or less popular genre because it's lack or popularity and lack of exposure would make everything seem more unique and original. Again, even if the law suit falls flat on it's face the legal fees alone could soak up the bulk of the game's funding.

Graphics aside the game has something most modern games lack: atmosphere! That's what makes it a truly great game to play at the middle of the night, with no lights on. Combine the game's good atmosphere with pacing and you have an action horror game that does a great job of giving you the heevy-jeevies.
