It seems like a careless decision by whoever chose the name. They probably should have expected this, it's not as though it would be hard to find out that there was a successful title owned by a rich company with this same name.

I'd wager, though I could be wrong, that the customers from said crossover would outweigh the kids that would decide to get this over whatever else they play. And enough money could sway pretty much any company.
How many more people would have sprung for this if they'd made a game called "Grand Theft Lego" and worked with Rockstar? Everybody would buy two. At that point, who cares if it slightly hurts the Lego brand?

Apart from some particular voice acting, I didn't see anything offensively bad. The art direction and score were outstanding. The story was odd, but at least creative.
