It would if New York had a strict felony homicide law like Georgia. I think lawsuit shows that New York doesn’t have such a law. And I wouldn’t want such a law. Say you rob a store and the owner accidentally shoots a bystander and you get charged with Murder 2? No thanks. That’s lazy justice. 

With over 70 people killed by motor vehicles in NYC this year and counting, you are incorrect.

Hate to sound like a right wing nut, but do some research. In NYC, it is perfectly legal to kill someone with an automobile so long as you “stay at the scene.” So long as it isn’t a hit and run, there are almost never any legal consequences for the party that does the killing.
