Whether or not both people were drunk is a pretty big factor, I think. Two drunk people that hook up when they wouldn’t have sober are, if not giving consent in a legitimate way, are at least giving equal amounts of consent.

I don’t feel like it’s that complicated. If you’re unable to actively engage in sex, if you are incapable of moving, you are not capable of giving consent. If you are actively engaging in sex, excited, moving, vocalizing, that is giving consent.
