It is basic science. Seeds are spices, leaves are herbs. Your example of fennel is flawed though. One is a seed (Herb) the other is a bulbous plant. Not a leafy plant. So Fennel Seed would be a spice and the fennel plant would be a Foeniculum. And coincidentally the only one of its kind.
