ALL fan films are technically infringing. ANY use of copyrighted material outside of fair use is illegal. It does not matter if they are making money off of it or not. It is up to the owner of the copyright to decide when to enforce it. Whatever stuff they’ve allowed in the past is irrelevant.

“Let’s Play” type content is fair use. If it weren’t, the top streaming/videomakers in the world would have had their pants sued off. They take donations, ad revenue, Patreon, etc. all off the content they create which incorporates someone’s IP, and it is legal.

Star Trek fan films have become somewhat of a cottage industry on Kickstarter. New Voyages, Star Trek Continues, and Star Trek: Renegades all had successful Kickstarters (some had multiple Kickstarters). Also, Axanar had an Indegogo campaign and did some of the others.

Even using patreon is not legal for your purposes

Actually other projects have kickstarted, that’s not even the problem. It’s when they founded the studio and started paying themselves salaries it became a problem.

Keep in mind CBS is going after them because Axanar is no longer a “non-profit” production, since they are paying themselves with Kickstarter money and planning on using funds to open their own production company.
