An animal counts as a person when it is a Human.
We don't consider all of the mentally handicapped to be persons in the full sense of the word, not by a long shot. Many of them are not allowed to make their own decision, or have any semblance of privacy, for example.
The problem with that concept is that human civilization is predicated upon the idea that people will not be allowed to prey upon people.
