The consumer produced all the required documentation for the “incentive” (credit? deduction? rebate? anyone know?), and they can reasonably argue that the documentation was valid to the best of their knowledge.

VW’s software was written to sense the EPA testing scenario. If another country uses a different testing protocol or scenario, the software won’t engage ECO mode (if everything otherwise works properly).
