I was wondering if it was a BMW. My friend had one, same age as yours, it was really jerky and abrupt in the situations you described.

What kind of car do you have? In the Subaru the adaptive cruise works great. It only hits the brakes if it senses a really fast deceleration of the car in front, or if an incoming car is really cutting it close. Usually it just gently backs off.
