Many of us will re-sell their devices down the road. Cases protect resale value.

I tend to put my phone face-down on my desk; having a case that protrudes ever-so-slightly past the front of the phone does indeed protect the screen.

I think there was more to the Apple v Samsung case than just icons, but I agree with your point.
While the inspiration is obvious, there are a couple of tiny differences that might work in Apple's favour in court:
Seriously, the mobile website is your best bet. Way better interface than the app (which hasn't been updated since iOS 2 as far as I can recall!). Put a bookmark to it on your home screen, tuck the app away into a folder (or upgrade to iOS 6 and let it disappear altogether!) and move on :)

In all the time you spent writing angry posts on Giz, you could've figured out that you CAN disable the update checker:
I write a lot of scripts for my own uses, and can have them send out Growl notifications when they've performed their task; very handy, and I can't do it via NC.
The free version works fine, and Growl still makes it available for download on their website. No one's making you upgrade.
