Emulators aren’t illegal, but using the bios for a system is as it’s IP theft.  Most homebrew emulators rely on bios dumps from the consoles to run, so a custom bios would have to be reverse engineered to make things nice and legal.  For some systems that is already done, but for others it isn’t.
