That's totally true, not arguing that. However, someone could come up with a novel ESC system that does not require ABS. Probably wouldn't be worth it, and the regulators may state that ABS has been de-facto required by ESC if someone tried, but it's still an option today.

They aren't mandatory, I promise.

The US requirement is for stability control, which includes ABS 100% of the time; The two systems have separate warning lamps to the drive. The system cost is mostly in the ABS components, the ESC is a relatively inexpensive adder. Model Year 2012 was the first year for this requirement. If you know of an instance

ABS, Traction Control, and Stability Control are now mandated. Or at least 2 of the three are. Once they've added ABS, it's almost no cost other than up-front tuning to add TCS and Stability control, since they use the same hardware.

I'm actually amazed at how many cars allow you to turn off TCS. I mean, I understand the point, but my boss's Ford Flex has a big button in the console that says TCS off and a hilarious depiction of a Flex careening off the road.
