The only logical argument is how the law views it. And the law views it as something other than theft.

I have always found it odd that gamers can do these “Let’s Play” videos showing them playing the whole game while talking about it and make money off of it... but if you, say, made a “Let’s Watch” video of you watching a whole movie while talking about (whether profiting from it or not), that is copyright infringement.
XInput is what Xbox (and similar) controllers use, I guess you could consider it a replacement for DirectInput. It is the better option these days.
DirectInput games can have trouble using both at the same time, X-Input ones rarely do.

Most do. Bethesda has a handful of games, that doesn’t make up the majority of PC games with controller support. You can significantly increase the amount of games if you include emulation, too.
Actually, most do. There are some sad examples, like any Bethesda game basically, but generally you can use them both at the same time all you want.
