That's the point. I'll bet he was offered a loaner car by contract, not specifically a Mercedes. Or, at the very least, with the 'where available' caveat. If the dealer had been smart they'd have said 'we don't have any cars in stock you can take a dog in, so we'll rent you one instead'.
