I believe the solution offered is in the situation of no headset plugged in (but you can still hear others through TV speakers). Or in the instance that you do have your headset on, but clearly have your mic muted (physically with a button).

If anything, they should be dimmed out and permanently placed at the bottom of the library until redownloaded. Or at least have the option to hide them or something.
