I would imagine the child wasn't noticed, kids can be extremely quiet in car seats, if not asleep. The statement about being within legal right is odd. Yes it's their property, but it is just weird wording about it.

Typically it's illegal to keep a child/infant unattended in a car. Whoever repossessed the car probably didn't expect such negligence from the owner.
