False equivalency, try again. Quick Saves are built into the game by the designers as a portion of the game itself. Pause, much less pause for best input was not.

Working in the industry, I can tell you that very rarely is an exploit figured out by the player base without us knowing about it soon after it’s first used. I’m not so sure about that. How about car enthusiast channels that show off their track days and mechanics tricks? Or gun enthusiasts showing off this cool rail sight with their Sig? They are all using someone else’s IP in very much the same way, but no one bats an eye at any of those making ad revenue.

It’s murky because your usage could still be covered under fair use as a transformative piece. But there’s no real way to tell that without going through the legal process for it. And how many Youtubers have the cash to go through 2-3 court cases against a multinational like Nintendo?

Yep. Nintendo can claim that all they like. However, it’s a federal right under fair use law. The thing about ToS and CoCs is that the maker can claim or ask you to sign away any rights they want. It doesn’t mean it would stick in court.

How so? Alright, put aside for a moment that it’s 99% *not* like this (very likely a net downloaded pre-patched thing), but if a user took the dump of their own cart, grabbed the ROM and applied an IPS patch to it, they have done nothing illegal. Sure, Nintendo hates it, but nothing illegal has occurred.

I can certainly get behind that. It starts to get really rough for the individual creator when ad revenue or what have you comes into things.

Nintendo hasn’t taken Alex Tan to court either, so that’s not really an argument either way unless/until it does happen.
