Except it’s not illegal to resell products. They aren’t claiming they made these, they aren’t claiming nike didn’t make them, they aren’t pretending they did anything but buy a nike, modify it, and resell it. This would be like Ford suing a shop that bought a new mustang, tuned and modified it, and then resold it.
I doubt it will “harm” their brand any more than than the whole Kaepernick deal “harmed" it.

If you have a bunch of small 401ks from past jobs they really should be consolidated. Compound interest and all that.
One thing that these type of things never seem to account for are changes in compensation. When I was 30, I probably did have ~1X my annual salary in my 401k. Through job change and advancement, I made considerably more by my mid 30's, so by these types of measures I was “off track” almost overnight.
