Legally, drivers are much more responsible. Unless you are jaywalking or being otherwise irresponsible, if a driver hits you with their car while you are walking (or riding — bikes are required to follow the same traffic laws as other vehicles, however) down the street, and a car hits you, the driver is responsible.

It’s the driver’s responsibility to NOT HIT people, not the other way around.
