Idiot thwarted by oxymoron
That’s a pretty bad, short term look to take. I suggest you look into California’s long history of making poor, knee jerk reaction laws
Aren’t we, as liberals, against mandatory minimums?
Yup. Every push for “harsher criminal justice” has resulted in a widening income gap, a widening racial gap, and more inequality all around. Our fear of the sexual assault crisis in this country often gives politicians more ways to seize control and broaden the divide.
Your fear is justified. Hell, I’d call your scenario a near certain consequence.
“Brock Turner’s sentence was harsher than 97% of all rapists sentenced”
Wow. You’re stupid.
How about not making knee jerk reaction laws that limits a judge’s ability to use discretion during sentencing. Ya know something that California has had a horrible, well documented track record with. These overreaction laws usually come with severe problems that no one, at the time, stopped to consider
My fear, as ever and as always with mandatory minimums in a white supremacist culture, is that the mere existence of them with respect to sexual assault will make it less likely for white rapists to even see the inside of a courtroom. That is: we’ll have to endure twice the amount of “their poor lives / futures”…
Bad set of facts: Brock Turner’s light sentence.
You are a piece of shit if you’re laughing at someone’s injury.
My concern with this is that the outcome will be that people like Brock will simply not be charged with the crime that carries this requisite minimum. A defense attorney will find some way to get their client charged with some other, lesser crime and still avoid the sentence.
You could bring up the most unsavory, reprehensible people our society has to offer. I still don’t think it warrants making our criminal justice system more draconian.
Yes, there is widespread bipartisan agreement on this question and it spans the entire ideological spectrum.
So, the next time a 18 yo has sex with his 17 yo gf, he’ll face a 3 year minimum sentence. Great law and in no way the panic reaction of a legislature hounded by social media!
Oh thank God, I was just thinking about how too little power the carceral state already has and how there’s just too much emphasis in our system on restorative justice that centers the victims in any way rather than just being punitive for the sake of being punitive. CA to the rescue yet again!
No, they’re opposed to mandatory minimum sentencing laws, which are disproportionately used to incarcerate people of color.
No no no no no this is not how things get better. Goddamnit.
This is an example of a bad set of facts, and public outrage in search of a target, leading to a bad law.
