This is pretty standard NDA stuff, especially in product development areas. I do auditing and work under similar restrictions. We're not allowed to even let slip the names of companies under audit, let alone detail of the audits themselves

HowIsYourFlat below is right, I just Google'd around and apparently they did remove the processor that was originally in the prototype before releasing. In that case, I don't really know why you wouldn't be able to use any standard Xbox mic....
Once it's open they can no longer just put it back on the shelf and sell it as new, which is why there's a 15% restocking fee at stores like Best Buy. So if you want them to open the box so they can check it and charge you 15% of the sale price to return it, then you've got a great idea
