They did not infact complete the service they billed the customer for, ie committed fraud. Wrong.  The dealer/mechanic basically implied that they did tighten the lug nuts but failed to do so.  After all, nobody in their right mind would accept a car back from the mechanic when the nuts are not tightened.  It is implied.
