The list is a relatively new thing (late 90s) and the recidivism rates were low compared to other crimes even before it existed.
I think this is referring to the recidivism rate of offenders that were convicted and sentenced, i.e. the ones that would be on the list. Different from a “campus rapist” that serially offends but is never prosecuted and put in jail.

The law this guy was prosecuted under specifically criminalizes taking pictures of people while they are in “private locations” so does not cover something like this that happened in public.
