Our weird fetishism for the Founding Fathers is equivalent to that of the citizenry of Rock Ridge's for Randolph Scott. It means we don't tamper with the constitution as much as we might, for good or ill, so we end up with these sort of kludges.

It's one of the reasons this person does, because the characters are more complicated than "we're the good guys." It's by definition just my interpretation of what I watched. I'm a soft believer in death of the author anyway, so I don't even wonder whether Whedon meant it or not too much.
