See, courts are made up of lawyers. They are very good at following rules. It makes them very predictable. This is hardly new ground legally - they’re far from the first to try this. There is no legal question here.
His legal fees in this case are paid by YouTube (read: Google) in an effort to discourage spurious DMCA takedowns and defend Fair Use. It’s actually really weird that the article doesn’t mention that.
