They could classify videos as "Let's Play", but those videos are kind of in a nebulous legal territory already.

They are now, did you read the article? The problem is ContentID got enabled for a bunch of MCV affiliates that didn't have it enabled before. This is probably because the MCVs weren't doing their job and policing their own videos.

They have to apply and be accepted as a content creator in Content ID.
