If I’m reading this correctly the Merc was merging onto the highway as the truck was moving into the driving lane of a two lane section of road. As such, wouldn’t the truck have had right of way as it was already on the highway regardless of the lane it was currently in?

Uhhhhh... maybe some parts of Canada require snow tires but I spent some time living in Nova Scotia and they had no such requirement.
