The first amendment guarantees that a set of freedoms won’t be infringed upon by the government. If I put a sign on my door that says “no one may mention Bernie Sanders in my home, or I will kick you out” and then follow through on that promise, no rights are being violated.

Tailgating is not a victimless crime. If you are following so close that you can’t stop, which this driver clearly was, you are putting the lives of the people in the car in front of you in danger.
I flash my brakes at them first 3 times, if they continue to tailgate I slow down until they go around. This is of course on 2 lane roads. On 4 lane roads I am in the right lane 99% of the time (unless passing). Looks like the guy got what was coming to him IMO.
