The coach did not have a legit 503(c) set up. The guy who paid him set up a not actually legit 503(c). And again there are emails explaining the whole setup. You can’t claim you didn’t know when the prosecutors have emails demonstrating amply that you did in fact know.

I believe it’s the fraud and money laundering. The IRS was the one that first brought the case to the feds. The US attorney who brought the charges emphasized that angle from the start. They deducted their bribes as charitable donations.

If they had made the donation to USC they could make that argument. They didn’t. They have emails where the whole scheme is discussed. They knew they were paying a guy to pay a guy. We know they knew it was a sham non-profit. Now they can sure try to make the argument but the IRS knows they know it wasn’t a charity. 

The problem with that defense is that they deducted the bribe from their taxes. That’s what they are in trouble for. And the whole coach’s discretion thing doesn’t extend of course to the choice to make their bribe a tax write off.
