Here’s the thing; we don’t automatically assume everyone involved in an MVA was drinking and administer sobriety and blood alcohol tests.
I’m not educated enough in this particular facet of US law (because like most sane people, I’m an insured motorist) but I do know that if the DMV (at least in my state) gets wind that you are uninsured they will suspend your license.
